1. Acceptance of Terms

19. Limitation of Liability

TO THE MAXIMUM EXTENT PERMITTED BY APPLICABLE LAW, KASTKING AND ITS OFFICERS, DIRECTORS, EMPLOYEES, AFFILIATES, AND SERVICE PROVIDERS WILL NOT BE LIABLE FOR INDIRECT, INCIDENTAL, SPECIAL, CONSEQUENTIAL, OR PUNITIVE DAMAGES ARISING OUT OF OR RELATED TO THE USE OF OUR WEBSITE OR SERVICES.

THIS MAY INCLUDE LOST PROFITS, LOST BUSINESS OPPORTUNITIES, LOSS OF DATA, OR BUSINESS INTERRUPTION, TO THE EXTENT SUCH LIMITATIONS ARE PERMITTED BY LAW.

TO THE MAXIMUM EXTENT PERMITTED BY LAW, KASTKING'S AGGREGATE LIABILITY FOR CLAIMS ARISING FROM A PARTICULAR PRODUCT PURCHASE WILL NOT EXCEED THE GREATER OF:

  • THE AMOUNT PAID FOR THE PRODUCT GIVING RISE TO THE CLAIM; OR

  • ONE HUNDRED U.S. DOLLARS ($100).

THESE LIMITATIONS DO NOT APPLY WHERE PROHIBITED BY LAW OR TO LIABILITY THAT CANNOT LAWFULLY BE LIMITED, INCLUDING CERTAIN PERSONAL INJURY, PRODUCT LIABILITY, FRAUD, OR STATUTORY CONSUMER PROTECTION CLAIMS.

SOME JURISDICTIONS DO NOT ALLOW CERTAIN EXCLUSIONS OR LIMITATIONS OF LIABILITY. IN SUCH CASES, THE APPLICABLE LIMITATIONS WILL APPLY ONLY TO THE EXTENT PERMITTED BY LAW.

20. Indemnification

To the extent permitted by applicable law, you agree to indemnify and hold harmless KastKing and its officers, directors, employees, affiliates, and authorized representatives from third-party claims, damages, liabilities, and reasonable expenses arising from:

22. Arbitration Agreement

IMPORTANT: THIS SECTION MAY AFFECT YOUR RIGHT TO BRING A CLAIM IN COURT.

To the extent permitted by applicable law, disputes arising out of or relating to these Terms, the Website, or products and services purchased through the Website may be subject to binding individual arbitration.

Informal Dispute Resolution

Before initiating formal arbitration, you and KastKing agree to make a good-faith effort to resolve the dispute informally.

A party seeking resolution should provide written notice describing the dispute, relevant facts, and requested relief.

The parties will have 30 days after receipt of the notice to attempt informal resolution, unless they mutually agree to extend that period.

Arbitration Procedures

If the dispute cannot be resolved informally, either party may initiate arbitration administered by the American Arbitration Association (AAA), subject to its applicable consumer arbitration rules and applicable law.

Arbitration will generally be conducted before a neutral arbitrator.

The allocation of arbitration fees and expenses will be governed by applicable arbitration rules and law.

Exceptions

This arbitration provision does not prevent either party from bringing an eligible claim in small claims court.

It also does not apply to claims or disputes that cannot lawfully be required to proceed through arbitration.

Consumer Rights

Nothing in this section limits rights or remedies that cannot be waived under applicable law.

This arbitration provision should be reviewed and finalized by qualified legal counsel before implementation, including the procedures for consumer notice, arbitration location, fee allocation, and any applicable opt-out rights.

23. Class Action Waiver

TO THE EXTENT PERMITTED BY APPLICABLE LAW, YOU AND KASTKING AGREE THAT DISPUTES SUBJECT TO ARBITRATION WILL BE RESOLVED ON AN INDIVIDUAL BASIS.

NEITHER PARTY MAY BRING OR PARTICIPATE IN A CLASS, COLLECTIVE, OR REPRESENTATIVE ARBITRATION PROCEEDING EXCEPT WHERE SUCH A WAIVER IS PROHIBITED BY LAW.

THIS SECTION DOES NOT WAIVE RIGHTS THAT CANNOT LAWFULLY BE WAIVED.

THE ENFORCEABILITY AND EFFECT OF THIS PROVISION ARE SUBJECT TO APPLICABLE LAW AND THE ARBITRATION AGREEMENT IN SECTION 22.

24. Governing Law

These Terms are governed by the laws of the State of Texas, without regard to conflict-of-law principles, except where mandatory laws of another jurisdiction apply.

Subject to the arbitration provisions and applicable law, disputes that are not subject to arbitration may be brought before courts of competent jurisdiction in Texas.

Nothing in this section deprives consumers of protections or legal rights that cannot be waived under applicable law.

25. Account Deletion

You may request deletion of your KastKing customer account by contacting:

Before processing a deletion request, we may take reasonable steps to verify your identity and protect against unauthorized account changes.

Upon account deletion:

  • Account access may be permanently disabled;

  • Eligible personal information may be deleted or anonymized;

  • Unused loyalty points or promotional rewards may be forfeited under applicable program terms;

  • Certain transaction, tax, warranty, security, or compliance records may be retained where required or permitted by law.

Account deletion does not necessarily result in the immediate deletion of all information associated with previous transactions.
